Farmland Preservation: Conservation Compliance Forms

​​​​​Certification of compliance

This form is used by county conservation staff to certify a farmland preservation program eligible landowner is compliant with all applicable​ state soil and water conservation standards. Each certification is issued a unique number that will be used at the time of a tax credit claim to verify compliance.

Notice of non-compliance

This form is used by county conservation staff to indicate when a farmland preservation program participant has come out of compliance with the state's soil and water conservation standards. An active notice of non-compliance will remove a participants eligibility to claim the farmland preservation tax credit beginning in the year the notice of non-compliance is issued. 

Please note that landowners who participate​ in the farmland preservation program through an effective farmland preservation agreement signed before July 1, 2009 or an effective farmland preservation agreement in an Agricultural Enterprise Area must maintain conservation compliance regardless if they claim the farmland preservation tax credit. 

Cancellation of non-compliance

​This formed is used by county staff to indicate when a previously non-compliant farmland preservation program participant has come back into compliance with the state's soil and water conservation standards. Once a cancelation of non-compliance is issued, an eligible landowner may resume claiming the farmland preservation tax credits being in the year the cancelation is issued.

Model Forms

​These are model forms that counties can use in order to verify, inspect and work with landowners who are participating in the farmland preservation program. Counties can use these forms for use or they can use these to model a new form to be used locally.
