Nursery and Christmas Tree Licensing

Who Needs a Nursery or Christmas Tree License?

Anyone selling more than $250 annually in perennial nursery stock or Christmas trees needs an annual nursery or Christmas tree license:

  • If you plan to grow and sell at least $250 in nursery stock during the year, you need a nursery grower license.
  • If you plan to buy and resell at least $250 in nursery stock during the year, you need a nursery dealer license.
  • If you plan to grow and sell at least $250 in nursery stock during the year, and you plan to buy and resell at lease $250 in nursery stock during the year, you need both nursery grower and dealer licenses
  • If you plan to grow and sell at least $250 in Christmas trees during the year, you need a Christmas tree grower license.

Nursery stock is defined by state statute as plants and plant parts that can be propagated and grown, excluding seeds, sod, cranberry cuttings, annuals, and evergreen trees grown for eventual harvest and sale as Christmas trees.
