Eviction Procedures

Wisconsin Statutes chapter 799 spells out the small claims court procedure that a landlord may use to evict a tenant. A landlord may obtain a prompt eviction order against a tenant whose tenancy is properly terminated under Wisconsin Statutes chapter 704 (see The Landlord-Tenant Relationship). The county sheriff executes the eviction order.

The Wisconsin Department of Agriculture, Trade and Consumer Protection has adopted rules to prohibit illegal “lockouts” and “self-help” evictions (see Unfair Rental Practices). For more information about evictions, contact the small claims court in your county.
