Post-Mortem Care

The Wisconsin Department of Safety and Professional Services (DSPS) and its affiliated examining boards regulate the following:

• Cemetery Authorities. The department regulates cemetery operators under Wisconsin Statutes chapters 157 (subch. II) and 440 (subch. VIII) and Wisconsin Administrative Code chapters RL 50-54.

• Cemetery Pre-Need Sellers. The department regulates persons who sell cemetery merchandise or undeveloped spaces under “pre-need” sales contracts. The department regulates these persons under Wisconsin Statutes chapter 440 (subch. VIII) and Wisconsin Administrative Code chapters RL 50 to 54.

• Cemetery Salespersons. The department regulates persons who sells or solicit the sale of 10 or more cemetery lots or mausoleum spaces during a calendar year. The department regulates these persons under Wisconsin Statutes chapter 440 (subch. VIII) and Wisconsin Administrative Code chapters RL 50 to 54.

• Funeral Directors. The department and the Funeral Director Examining Board regulate funeral directors under Wisconsin Statutes chapter 445 and Wisconsin Administrative Code chapters FD 1 to 6.
