Fireworks

Wisconsin Statutes section 167.10 regulates the manufacture, sale and use of fireworks. Local governments are primarily responsible for enforcing provisions related to the sale and use of fireworks. A local government may take court action against a person who violates Wisconsin Statutes section 167.10 or a local fireworks ordinance:

  • Violators are subject to civil forfeiture penalties of up to $1,000.
  • A court may enjoin further law violations. Persons violating a court injunction may
    be fined up to $10,000 or imprisoned for up to 9 months, or both.

The Wisconsin Department of Safety and Professional Services (DSPS) regulates fireworks manufacturers. A person who manufacturers fireworks without a license, or in violation of DSPS rules, is guilty of a class G felony.
