Agricultural Supplies

Pesticides

  • Pesticides must be registered with the U.S. Environmental Protection Agency (EPA). EPA registers pesticides and and pesticide labels for specific uses. Pesticide labeling must conform to the EPA registration.

  • Federal and state laws prohibit sale or use inconsistent with label directions. The Wisconsin Department of Agriculture, Trade and Consumer Protection enforces state pesticide laws.

Fertilizer and Related Products

  • Fertilizer must be labeled according to Wisconsin Statutes section 94.64 and Wisconsin Administrative Code chapter ATCP 40. Sellers must be licensed. A seller may not misrepresent fertilizer contents or make false performance claims.
  • Soil and plant additives must be labeled according to Wisconsin Statutes section 94.65 and Wisconsin Administrative Code chapter ATCP 40. Sellers must be licensed. A seller must also hold a permit for each product. Product labeling must be consistent with the product permit. A seller may not misrepresent product contents or make false performance claims.

  • Liming materials must be labeled according to Wisconsin Statutes section 94.66 and Wisconsin Administrative Code chapter ATCP 41. A seller may not misrepresent product contents or make false performance claims.
  • The Wisconsin Department of Agriculture, Trade and Consumer Protection administers licensing, packaging and labeling requirements for fertilizer, soil and plant additives, and liming materials.

Animal Feed and Pet Food

  • Commercial feed and pet food must be labeled according to Wisconsin Statutes section 94.72 and Wisconsin Administrative Code chapter ATCP 42. Sellers must be licensed. A seller may not misrepresent product contents or make false performance claims.
  • The Wisconsin Department of Agriculture, Trade and Consumer Protection enforces licensing, packaging and labeling requirements for commercial feed and pet food.

Agricultural and Vegetable Seed

  • Agricultural and vegetable seed must be labeled according to Wisconsin Statutes sections 94.38 to 94.46, and Wisconsin Administrative Code chapter ATCP 20.
  • The Wisconsin Department of Agriculture, Trade and Consumer Protection enforces packaging and labeling requirements for agricultural and vegetable seed.
