Consumer Product Safety
The Wisconsin Department of Agriculture, Trade and Consumer Protection (DATCP) regulates the sale of hazardous toys. Toys must comply with federal standards adopted by the U.S. Consumer Product Safety Commission. The Commission has adopted safety and labeling standards for toys and other articles used by children.
At the state level, DATCP regulates hazardous toys under Wisconsin Statutes section 100.37. DATCP has adopted rules (Wisconsin Administrative Code chapter ATCP 139) and may require safety labeling of toys. DATCP may ban a toy if it poses a serious hazard that cannot be adequately addressed by labeling.
