Performance Claims

• Wisconsin Statutes section 100.18 prohibits deceptive advertising and sales practices, including deceptive performance claims. For more information, see Fraudulent Representations details.

• The Wisconsin Department of Agriculture, Trade and Consumer Protection (DATCP) regulates unfair business practices under Wisconsin Statutes section 100.20. DATCP may prohibit unsubstantiated performance claims for products or services. A retailer may rely, in good faith, on information provided by the product supplier.
