Energy Savings and Safety Claims
A seller who claims that a product or service is safe, or will save energy, must be able to justify that claim. The seller must have reasonable substantiation on hand before making the claim (see Wisconsin Statutes section 100.21). The Wisconsin Department of Agriculture, Trade and Consumer Protection (DATCP) may require a seller to substantiate claims, and may prohibit unsubstantiated claims by rule or order.
